Acquird service agreement
This agreement describes the mandate given to Acquird by the client, the scope of the service, each party’s obligations, cancellation and refund terms, and the precise workings of the Zero Loss Guarantee.
1. Nature of the mandate
Acquird acts exclusively as the buyer’s agent and advisor. Acquird is not a dealer, an auto broker, a lender or an insurer. Acquird does not hold the client’s purchase funds, does not finance, does not insure and does not sign any document in the client’s name.
2. Scope of service
The service includes the discovery call, the vehicle search, presentation of a short list, negotiation of the price, trade-in value, rate, term and every product offered in the finance office, coordination of the pre-purchase inspection and document review before signing. Excluded: the vehicle price, taxes, registration, third-party inspection fees, transport (paid option) and insurance.
3. Client obligations
The client agrees to provide accurate information, to respond within a reasonable time to their negotiator’s validation requests, not to negotiate in parallel with a seller approached by Acquird without informing their negotiator, and to assume third-party fees (inspection, registration, insurance).
4. Cancellation and refund
Cancellation within 48 hours of payment and before the first approach to a seller: 100% refund. After the first approach: the portion of work completed is retained per the following schedule — 25% after the first approach, 50% after the short list is presented, 100% after a negotiated agreement is concluded. If the client chooses not to buy at the end of the process, no additional fee applies, but the package is not refunded.
5. Zero Loss Guarantee — terms
The reference listed price is the public listed price of the selected vehicle, recorded in writing in the file when negotiation begins; it is locked as of the first approach. Savings are calculated as follows: reference listed price minus final negotiated price, plus the value of finance and insurance products removed from the contract. If those savings are lower than the package fee paid (excluding the Delivery option), Acquird pays the client the difference, using the same payment method, within thirty days of vehicle delivery. Any claim must be filed within thirty days of signing. The detailed calculation and supporting documents are posted in the client portal.
6. No price guarantee and limitation of liability
Acquird guarantees no purchase price, rate, availability or specific timeline. Acquird’s total liability, on any grounds, is limited to the amount of the package fee paid by the client.
7. Governing law and jurisdiction
This agreement is governed by the laws applicable in the province of Quebec. The courts of the judicial district of Montreal have exclusive jurisdiction over any dispute, subject to the consumer rights provided by the law of the client’s province of residence.
